Terms and Conditions

1.Participation in the Healthy Bones Action Week Schools Competition 2015 (Competition) constitutes acceptance of these Terms and Conditions.  
2.Information on how to enter and prizes form part of these Terms and Conditions.
3.To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions shall prevail.
The Promoter
4.The promoter of this competition is Dairy Australia Limited (ACN 105 227 987), an Australian public company limited by guarantee with its registered office at Level 5, IBM Centre, 60 City Road, Southbank, Victoria, 3006 (“the Promoter”).
Who can Enter?
5.Entry is open to any Australian resident over the age of eighteen (18) years who is employed at a primary school in Australia during the Competition Period (as defined in Item 12 below).  
6.Employees of the Promoter and their immediate families and agencies associated with this Competition are ineligible to enter.
How to Enter
7.Entry is by validly completing the Promoter’s online entry form (located at and submitting a photograph showing the Promoter how the entrant’s school students are building strong healthy bones.  
8.Entrants must submit their own original work. Entry is free. Only one entry per school employee is permitted.
9.All entries must include the name of the primary school employee, employment position at the school, name of the primary school, full address of the primary school, the entrant’s school email address and school telephone number.  The Promoter will not be responsible for any late, or incomplete or incorrect entrant contact details. Incomplete, incorrect and incomprehensible entries will be deemed invalid and will not be included in the judging.
10.Entries not complying with these Terms and Conditions are ineligible and the Promoter reserves the right to disqualify any entrant if any entries do not comply with these Terms and Conditions.
11.Once submitted, entrants will not be permitted to change or withdraw their entry.
When to Enter
12.The Competition opens at 9am EST on Wednesday, 24 June 2015 and closes at 5pm EST on Friday, 24 July 2015 (“the Competition Period”).  Entries received after this time will not be accepted.

Selection of Winning Entry
13.This is a game of skill and chance plays no part in determining the winner.  The winning entry will be the best photo showing how an entrant’s students are building strong healthy bones, taking into account factors such as creativity, innovation and practicality.
14.The Competition will be judged by a panel of three judges chosen by the Promoter at its absolute discretion.  
15.The winner will be notified by Wednesday, 29 July 2015 by telephone using contact details provided in an entrant’s entry.
16.The judges’ decision is final and no correspondence will be entered into.  
17.Prizes are not transferable or exchangeable and cannot be taken as cash.
18.The winning entry will be published on the Schools Competition page of the Healthy Bones Action Week website at
19.On submission of a valid entry, each entrant’s school will receive one Discover Dairy Teacher’s Pack consisting of dairy educational resources to use during Healthy Bones Action Week.  These resources will be dispatched for delivery to the school by Australia Post no later than Wednesday, 29 July 2015.
20.The resources will be chosen at the discretion of the Promoter, and will be subject to availability at the relevant time.
21.Dairy Australia will not be liable for any delays in receipt of resources caused by Australia Post or other factors outside Dairy Australia’s control.
22.The primary school of the winning entrant as deemed by the judges will win (a) a one (1) hour school visit from Olympian and Legendairy Ambassador Michael Klim. The visit includes a twenty (20) minute presentation from Michael Klim, question time, photo opportunities and Michael’s attendance at a dairy morning tea; and(b) Provision of a selection of dairy foods for a morning tea on the day of Michael Klim’s visit.   
23.The date and time of the visit will be negotiated with the winning primary school, the Promoter and Michael Klim’s management Elite Sports.  The school visit must occur during Healthy Bones Action Week, August 3-7, 2015.   
24.The dairy foods supplied to the winning school will be at the discretion of the Promoter, although the Promoter will consult with the winning primary school. The time and day of delivery of the dairy foods will be negotiated and agreed between the Promoter and the winning school.
25.If the prize (or an element of the prize) is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize (or an element of the prize) for a prize of equal or greater value. Each prize must be taken as stated and no compensation will be payable if the winner is unable to use the alternate prize.
Further Terms and Conditions
26.It is the entrant’s responsibility to provide accurate contact details and to seek and obtain any relevant permissions from the primary school and parents or guardians regarding participation by the entrant’s school students in the Competition and in particular permission for usage of the photos featuring the school students
27.Entrants undertake that their entries are their own original work and do not breach of any third party intellectual property rights.  Entries will not be returned and all entries, including the copyright subsisting in the same, become and remain the property of the Promoter.  
28.By entering the Competition, entrants consent to the Promoter publishing or causing to be published any of the entries received including on the Promoter’s website. .
29.Dairy Australia is bound by the 13 Australian Privacy Principles (APPs) contained in the Commonwealth Privacy Act 1988 (as amended by the Privacy Amendment (Private Sector) Act 2000 and the Privacy Amendment (Enhancing Privacy Protection) Act (2012)) (collectively, “the Legislation”). Under the Legislation Dairy Australia has obligations to keep secure any personal information it collects, which it takes seriously.  Dairy Australia will use personal information it collects from entrants for the purpose of facilitating the Competition program and for such other secondary purposes that are related to the primary purpose which one might reasonably expect.  Dairy Australia may disclose an entrant’s personal information to authorities if an entrant is a Competition winner, or otherwise as required by law. Further information about how Dairy Australia handles personal information and how entrants can access their personal information can be found in our Privacy Policy at Dairy Australia will not sell, rent or loan our contact lists to third parties.  In addition, any emails that an entrant receives from Dairy Australia will include an option to unsubscribe.  
30.Without limiting the previous clause, entrants consent to the use by the Promoter, and its associates, of their entries for: (a) the purpose of obtaining feedback in connection with its programs and teaching materials and making use of that feedback; and (b) publicity purposes.
31.The winning entrant agrees to cooperate with a request by the Promoter for a publicity opportunity (including being interviewed and photographed) at the time of Michael Klim’s visit. The winning entrant agrees to grant the Promoter a perpetual, royalty-free, non-exclusive license to use any such footage and photographs in connection with publicity, including their use on on-line social networking sites, and the winning entrant (and his/her school and those connected with the school) will not be entitled to any fee for such use. Failure to be available at a mutually agreeable time during the said period may result in forfeiture of the prize.
32.The Promoter accepts no responsibility for and shall incur no liability in respect of any tax implications that may arise from the award of a prize from this Competition.  Independent financial advice should be sought by all recipients of such prizes.
33.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) to entrants and to their associated primary schools for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, or consequential, arising in any way out of the entrant’s participation in the Competition, including but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunctioning (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost or altered, damaged or misdirected (whether or not by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation of prizes to that stated in these Terms and Conditions; or (e) anything arising out of or in connection with taking or using (including, where applicable, the consumption of) the prizes, or any of them.
34.The Promoter reserves the right to amend these Terms and Conditions if this Competition cannot be run as originally planned.  The Promoter may also cancel or suspend this Competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this Competition.
