Terms & Conditions — Game of Skill

  1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
  2. Entry is open to all Australian residents. Entry is not open to directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this competition.
  3. The competition begins 12.01am AEST on 28/7/08 and closes 11:59pm on 30/8/08. (Competition Period).
  4. To enter, consumers must during the competition period, complete the entry form online, write in 25 words or less why their school canteen is the best bone-building canteen and answer three tiebreak questions.
  5. At the Promoter’s discretion, entries not fully complying with these conditions of entry may be deemed invalid. The Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, theft, destruction or otherwise.
  6. This is a game of skill; chance plays no part in determining the winners. Each eligible entrant will be individually judged (by representatives of the Promoter) based on their answer. The judges' decisions are final and no correspondence will be entered into.
  7. Entries will be judged at 11.00am AEST on 12/9/08 at Level 5, IBM Centre, 60 City Road, Southbank, Victoria 3006, Australia. Winners will be notified by telephone and mail. All reasonable steps to notify winners of the results of the judging will be taken by the Promoter.
  8. Major Prize: the best judged entry from all eligible entries received will be awarded $2,000 (inc GST) cash for the canteen and a Rebel Sports gift voucher to the value of $100 (inc GST). Cash prizes will be paid to the winner by cheque made payable to each winner.
  9. State Prizes: the best judged entry from each of the following: NSW/ACT, VIC/TAS, SA/NT, WA, QLD, will each be awarded $500 (inc GST) cash for the school canteen and one Rebel Sports gift voucher to the value of $50 (inc GST). Cash prizes will be paid to the winner by cheque made payable to each winner.
  10. Total maximum prize pool valued at $4,850 (inc GST).
  11. Each winner and canteen must, at the Promoter’s request, participate in any promotional activity (such as publicity and photography) surrounding the winning of their prize, free of charge. If the winning entrants are aged under 18 years, the winners parent or guardian must provide such consent in a form considered suitable by the Promoter at its discretion.
  12. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions.
  13. Prizes are not transferable or exchangeable and entrant prizes cannot be redeemed for cash. In the event for any reason a winner does not take an element of the prize, then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
  1. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  2. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes.
  3. If for any reason any aspect of this competition is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required.
  4. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
  5. All entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose of collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
